About EB-5 RURAL AREA PROJECT

On March 15th, 2022, the United States Congress passed the “EB-5 Reform and Integrity Act”, also known as the “EB-5 New Law”. The new law establishes Targeted Employment Area (TEA) projects, which include projects in high unemployment areas, rural areas, and infrastructure projects, providing significant policy benefits for investors.

The EB-5 TEA Rural Project refers to suburban or rural areas located BOTH outside MSA AND not in a town with a population of 20,000 or more based on the latest U.S. Census Bureau’s decennial population count.

Of the 10,000 EB-5 visas allocated each year, 20% (or 2,000 visas) are specifically reserved for Rural Area Projects. Every year, 2,000 eligible TEA Rural Project investors can submit their EB-5 visa applications and be processed immediately. They can either obtain their visas through overseas interviews or adjust their status through Form I-485 in the United States. If there are any unused visa slots in a given year, they will automatically be added to the next year’s quota.

USCIS has strict requirements for rural projects, and currently, qualifying EB-5 TEA rural projects are scarce. The Savannah Lakes Village (SLV) Golf Community Single-family Home Project is in compliance with the new law’s TEA Rural Project requirements.

Savannah Lakes Village (SLV) is located in the freshwater coastal region of western South Carolina, adjacent to the over 71,000-acre Lake Thurmond. This private lakeside community has a rich history and covers approximately 4,300 acres, combining leisure, sports, and social activities. Surrounded by federal parks and national forests, it enjoys rare and protected beautiful natural scenery. The community has completed $350 million worth of infrastructure and amenities. SMITH CENTRAL ATLANTIC REGIONAL CENTER LLC

SMITH CENTRAL ATLANTIC REGIONAL CENTER (SCARC) is a regional center that has obtained approval from the U.S. Citizenship and Immigration Services (USCIS) following the implementation of the new EB-5 policy. The regional center sponsors investment immigration projects and is responsible for monitoring and reporting compliance during project execution, as well as documenting indirect job creation.

ENTITY STRUCTURE

The SLV project is a rural area development project for single-family villa in a golf community under the new EB-5 policy in the United States. It benefits from the advantages brought by the new policy, such as the implementation of a third-party fund disbursement administrator mechanism. SLV has a unique investment architecture designed to protect the interests of investors.

SLV EB-5 Project Fund Exit Strategy

The SLV project plans to conclude its development by the end of the fifth year, achieving the goal of withdrawing the initial investment through the sale of all developed single-family homes or refinancing.

TOTAL EB-5 CAPITAL

The SLV EB-5 project is expected to accept 50 investors through EB-5, with a total investment amount of $40 million USD.

PROJECT PROGRESS

The land plot has been planned and prepared with all necessary infrastructure such as water, drainage, and internet in place, and construction will start in July 2023 and be completed by October of 2025 (28 months). The completed villas will all have independent property rights.

CONSTRUCTION PERIOD OF THE PROJECT

The project construction is divided into two phases: The first phase of project construction will consist of 155 homes with average size of 1,700-1,800 square feet with 3 bedroom two-bath configurations with two car garages. The proceeds from the first phase sales will be used to complete the development and construction of the second phase, which involves subsequent cyclic development and plans to launch a total of 482 detached villas.

EB-5 INVESTMENT PURPOSES

The EB-5 investment will be used to develop the land plots and villas at fair market prices, and they will be sold to private clients through the SLV Windfall Group, which has been developing and selling properties in the local area. And Sales will continue until October 2025.

EB-5Application Process

After investors complete the process of organizing documents, verifying funds, and making the necessary transfers under the guidance of an immigration lawyer, the U.S. Citizenship and Immigration Services (USCIS) reviews the qualifications of the investor, the investment project, and the source of funds to ensure they meet the application requirements. The EB-5 visa requires applicants to demonstrate that the funds have been or are being invested in the project.

Once the I-526 application is approved, the applicant and their family members will receive a two-year temporary green card.

  • If the applicant already has legal status in the United States, they will need to file an I-485 application to adjust their status to a green card holder.

  • If the applicant is outside the United States, they will need to apply for an immigrant visa using the DS-260 form and obtain the visa from the local U.S. embassy or consulate.

Note: In TEA projects, if the investor already holds a valid visa within the United States, the I-526 and I-485 applications can be submitted concurrently. Once approved, the applicant can simultaneously obtain an Employment Authorization Document (EAD) and an Advance Parole (AP) document for re-entry to the United States.

Applicants must legally enter the United States and submit the I-829 Application Form within 90 days before the expiration of their 2-year temporary green card to convert from a temporary green card to a permanent green card. The applicant and their family members will also be allowed to reside and work permanently in the United States
